Collections Cloud is not a debt collection or enforcement agency, but an intermediary platform which provides easy, affordable access to invoice recovery solutions via one of our trusted partners, on a one-time or subscription basis.

By using this Website or communicating with the Provider by electronic means, the User consents and acknowledges that all agreements, notices, disclosures, or any other communications satisfy any legal requirement, including but not limited to the requirement that such communications should be in writing.

E-commerce and Privacy

The Website www.collectionscloud.org offers financial collection services online or by telephone. The use of any service purchased from this Website is at the purchaser’s risk. The buyer/user indemnifies and protects the Provider against any loss, injury, or damages resulting from the use of any services on the Website.

Online Payment – Stripe Payments Gateway

All online credit and debit card payments are processed by Stripe Payments. Cardholders can visit http://www.stripe.com to view the Stripe security policies. Payments to Stripe are for Collections Cloud platform service fees only. Our service fees are processed in line with all relevant UK regulations and legislation.

Billing, Refund and Return Policy

The initial payment made via the Collections Cloud platform is exclusive of any fees charged by our partners and covers only the use of the Collections Cloud service (platform fees). This payment will be retained by Collections Cloud and will not be transferred to our partners or used as part of any debt recovery activities. Your credit or debit card statement will display a reference to Stripe for this transaction.

Our partners will contact you for approval in the event of any additional legal charges being levied, should a case reach this stage. You will be invoiced in advance for any associated legal costs for CCJ or High Court Writ progression.

Services are subject to availability. If a service is unavailable or cannot be provided, the Provider will issue a full refund within 30 days. If the client cancels an order or instruction, a 10% administration charge applies.

Litigation Costs

Where there are statutory court costs involved in litigation, Collections Cloud will notify clients of these costs prior to the commencement of any action. Clients are liable for all statutory costs and an invoice will be issued – and must be paid in full – to this effect in advance of the commencement of any action.

Tracing and Verification of Information

We use your personal information, as well as data from tracing providers and publicly available sources, to verify your identity and to ensure we have your most current contact information. This is a crucial step in our debt collection process. Any updated contact details or other relevant information gathered during this tracing process may be shared with our client who is the original creditor.

Credit Reporting and Propensity to Pay Scoring

To help us manage your account and make informed decisions, we may obtain credit information about you from credit reporting agencies or other data providers. This data is used to create a propensity to pay score, which is a key part of our automated decision-making processes regarding payment plans and account handling. This information will not be shared with any third parties outside of our company, except as required by law or with a creditor where a prior signed agreement is in place and specifically to assist in the collection of monies owed to that creditor. We adhere to all relevant credit reporting and data protection regulations in this process.

Updates to Terms and Conditions

The Provider reserves the right to change, modify, add, or delete parts of these Terms and Conditions at any time. Updates will take effect upon being posted on the Website. The User agrees to check these Terms and Conditions regularly and accepts any changes by continuing to use the Website.
